- •Arrest authority is the highest-yield topic. Under CPL §140.30, a security guard (a private person) may arrest for a FELONY only if it was IN FACT committed, and for a lesser offense only if it was committed IN THEIR PRESENCE — and must deliver the person to police without unnecessary delay.
- •New York imposes a DUTY TO RETREAT before deadly physical force (Penal Law §35.15) where you can retreat with complete safety — except in your own dwelling. New York is NOT a 'stand-your-ground' state; don't assume the rules of other states.
- •Your primary job is to observe and report. A security guard is not a police officer, has no general search authority, and is not required to give Miranda warnings. Exceeding your authority (unlawful detention, excessive force) creates liability for you and your employer.
- •The DCJS exam is in English. Use the Chinese & Spanish explanations to learn the concepts, but the exam itself is given in English — learn the key English legal terms you'll see on test day. (The DOS application form exists in several languages, but the exam does not.)
